You send it directly to the closing attorney who then closes the transaction using your money. The attorney has us sign a Deed to Secure Debt at closing ensuring that when we sell the property, you are the first person to be paid. Your name will be filed as the lender of record on the property in first position. Instead of it saying "Loan from Wachovia" on the deed, it will say "Loan from <insert your name here>".
